1.1 Who we are. Bonded Out is software provided by Bonded Out, LLC, an Alabama limited liability company based in Florence, Alabama ("Bonded Out," "we," "us"). By creating an account, clicking "I agree," or using the service, the bonding company ("Company," "you") and every user it adds agree to these Terms.
1.2 What Bonded Out is, and is not. Bonded Out is a record-keeping and communication tool for licensed bail bonding companies. Bonded Out is not a bail bonding company, surety, insurer, law firm, court, law enforcement agency, or monitoring center. We do not write bonds, decide who gets a bond, supervise defendants, or give legal advice. The Company makes every bonding, surrender, and enforcement decision.
1.3 Accounts. You must be a licensed bail bonding company, or its owner, agent, or employee, and at least 18. You are responsible for everything done under your account, for keeping logins private, and for your agents' use. Tell us right away at support@bondedout.com if you think an account was misused.
1.4 Your data. You own the records you put in Bonded Out (clients, bonds, payments, documents, photos, monitoring data). You give us permission to store, process, and transmit that data only to run, secure, support, and improve the service, and as the law requires. We don't sell your data. Details are in the Privacy Policy.
1.5 Your responsibilities. You agree to:
1.6 Texting. Texts are sent from Bonded Out's messaging service on your behalf. You are responsible for the content, the recipient's consent, and honoring opt-outs. We may block or pause texting that risks carrier or legal violations. The SMS program rules are in Section 4.
1.7 Payments you collect. Client payments run through your own payment processor (for example, Clover). Bonded Out is not a party to those payments, doesn't hold the money, and isn't responsible for chargebacks, fees, or disputes.
1.8 Subscriptions and add-ons. Plans, prices, and add-ons (including Scout AI, GPS Check-Ins, and Scout Band) are listed on the pricing page and in My Account. Subscriptions renew automatically through Stripe until canceled. Add-ons are billed with your subscription. Fees already paid aren't refundable except where the law requires. We may change prices with at least 30 days' notice.
1.9 Add-on terms. If you use Scout AI, GPS Check-Ins, or Scout Band, the add-on terms in Sections 2 and 3 also apply and control if they conflict with this section.
1.10 Availability. We work to keep Bonded Out running, but the service, texts, emails, alerts, and third-party services it relies on (phone carriers, GPS, map, payment, hosting, AI, and monitoring providers) can be delayed, interrupted, or wrong. Don't rely on Bonded Out as your only way to track court dates, payments, or clients.
1.11 Disclaimer. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, BONDED OUT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
1.12 Limitation of liability. TO THE FULLEST EXTENT THE LAW ALLOWS, BONDED OUT IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, FORFEITED BONDS, BOND PAYOUTS, MISSED COURT DATES, A CLIENT FLEEING OR NOT APPEARING, OR LOST DATA, EVEN IF WARNED THEY WERE POSSIBLE. BONDED OUT'S TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE FEES YOU PAID BONDED OUT IN THE 12 MONTHS BEFORE THE CLAIM.
1.13 Indemnity. You will defend and hold harmless Bonded Out, LLC and its members, managers, and employees from claims, losses, fines, and costs (including reasonable attorney's fees) arising from your use of the service, your data, your texts, your monitoring of any person, your bonding decisions, or your breach of these Terms or the law.
1.14 Suspension and ending. You can cancel anytime in My Account. We may suspend or end an account that breaks these Terms or the law, or that puts others at risk. After cancellation you can export your data for 30 days; after that we may delete it, except what we must keep by law.
1.15 Disputes. Alabama law governs these Terms. Any dispute will be brought only in the state or federal courts serving Lauderdale County, Alabama. Claims must be brought individually, not as part of a class.
1.16 Changes. We may update these Terms. We'll post the new version with a new date and notify account owners of material changes by email or in the app. Continuing to use Bonded Out after the change means you accept it.
1.17 Contact. Bonded Out, Florence, Alabama · support@bondedout.com
2.1 What Scout AI does. Scout AI answers questions about your Company's Bonded Out records, drafts texts and messages, and can watch for possible re-arrests of your clients using outside arrest and booking data.
2.2 AI can be wrong. Scout AI uses artificial intelligence. Its answers, summaries, drafts, and alerts can be incomplete, out of date, or wrong, and may sound confident when they are. Check anything important against your records and official sources before acting on it.
2.3 You decide, not Scout. Scout AI never makes bonding, surrender, arrest, collection, or legal decisions. Don't use Scout AI's output as the only reason to revoke a bond, surrender or arrest a client, contact law enforcement, or take action against a client or co-signer. A licensed person at your Company must review it first.
2.4 Drafted messages. Texts Scout AI drafts are only sent when your user sends them. You are responsible for every message you send, including its accuracy and legal compliance.
2.5 Re-arrest alerts. Re-arrest alerts come from third-party public records sources. They can miss arrests, arrive late, or match the wrong person (for example, someone with the same name). An alert is a lead to verify, not a confirmed fact. Confirm identity and status with the jail or court before acting. Your use of this data must follow the source's terms and any law that applies to background or arrest records, including the Fair Credit Reporting Act where it applies.
2.6 How your data is used. To answer your questions, the relevant parts of your Company's records are sent to our AI provider for processing under business terms that don't allow it to train its models on your data. Scout AI only sees your own Company's data.
2.7 No liability for AI output. In addition to Section 1.12, Bonded Out isn't liable for losses caused by relying on Scout AI output or re-arrest alerts, including a missed, late, or wrong alert.
3.1 What these add-ons are. GPS Check-Ins texts a client a link at random times to take a selfie and share their phone's location. Scout Band is a wrist or ankle monitoring device the client wears that pairs with the Scout app on their phone; it reports location from the phone, whether the band is near the phone, tamper and strap-cut events, battery, and signal. Bonded Out shows this information and sends alerts. Together these are "Monitoring."
3.2 Monitoring is a tool, not supervision. Bonded Out does not watch clients, staff a monitoring center, or respond to alerts. Your Company is solely responsible for deciding who to monitor, reviewing alerts, and deciding what to do about them. Bonded Out never contacts law enforcement, courts, clients, or co-signers about an alert on your behalf.
3.3 Limits you accept. Monitoring can fail or be wrong. Location comes from the client's phone and can be inaccurate, delayed, missing, or faked. The band only shows it is near the phone, not that the phone is with the client. Alerts can be late, missed, duplicated, or false because of dead batteries, phones turned off, no cell or GPS signal, Bluetooth problems, device or app failure, carrier or provider outages, or tampering. Monitoring does not prevent a client from fleeing, committing a crime, harming anyone, or missing court.
3.4 Consent and legal compliance. Before monitoring anyone, your Company must:
3.5 Devices. Scout Bands are bought and owned by your Company. You're responsible for fitting them correctly, cleaning and inspecting them, charging guidance to clients, keeping your inventory accurate, and recovering bands when monitoring ends. Device warranties come from the manufacturer, not Bonded Out. Stop using a band that looks damaged or causes irritation.
3.6 Health and safety. Scout Band is not a medical device and is not for emergencies. Don't put a band on anyone who objects for medical reasons (for example, skin conditions, swelling, or circulation problems) without a doctor's okay.
3.7 Evidence. Monitoring records are business records of your Company. Bonded Out doesn't certify them for court and doesn't guarantee they'll be accepted as evidence. Contact us if you need a records custodian statement.
3.8 Monitoring data. Locations, selfies, and alerts are stored with your Company's records and kept while your account is active, then handled as in Section 1.14 and the Privacy Policy. You may set shorter retention as your policies or the law require.
3.9 No liability for Monitoring. In addition to Section 1.12, Bonded Out, LLC and its members, managers, and employees are not liable for any loss or claim arising from Monitoring, including a client's flight, non-appearance, new offense, injury to anyone, bond forfeiture or payout, a missed, late, or false alert, device failure or injury, or a claim by a client or co-signer about being monitored. Your Company's indemnity in Section 1.13 covers these claims.
3.10 Ending Monitoring. We can pause or end Monitoring for an account that doesn't follow this section, or if a provider (including the device maker) stops supporting the service.
There are three ways a person can agree to texts. In every case the checkbox is unchecked by default, and no texts are sent until the person has opted in.
When a client or co-signer signs bond paperwork in person with their bail bond agent, the paperwork includes a field for their mobile number and this unchecked checkbox:
Only if the box is checked does the agent mark that person as "agreed to texts" in Bonded Out. The signed paperwork is kept on file by the bail bond company. View an image of the paper form's text message consent section.
Co-signers can complete the bond paperwork online. The agent sends them a private, one-time link (by email, or by text only if they ask for it — see method 3). The online form asks for their mobile number and shows this optional, unchecked checkbox above the signature:
Bonded Out records whether the box was checked, along with the date and time the packet was signed. Only people who checked it receive texts.
If a co-signer asks their agent, in person or by phone, to text them the link to the online bond packet, the agent must confirm in Bonded Out that the co-signer asked for it before sending. That person receives a single text with the link, for example:
No other texts are sent to that number unless the person also opts in with the checkbox in the bond packet (method 2).
After someone opts in, the first text they receive is:
A bail bond company may enroll a client in GPS check-ins as part of their bond, after the client signs a written monitoring consent. Enrolled clients get check-in texts at random times during the hours the company sets. Each text has a one-time link that opens in the phone's web browser; there is no app to install. To check in, the client takes a selfie with the phone's front camera and allows the browser to share the phone's location. A check-in without a selfie is not accepted. For GPS check-ins, location is collected only at the moment of a check-in, never continuously. The selfie, location and time are shared only with the bail bond company that sent the request. Check-in texts are part of the Bonded Out SMS program above and follow the same opt-in, STOP and HELP rules.
A bail bond company may also require a client, with the client's signed consent, to wear a Scout Band monitoring device and use the Scout app on their phone. While a Scout Band is active, the Scout app reports the phone's location and the band's status to that bail bond company regularly, not only at check-in times. See Section 3 and the Privacy Policy.
See our Privacy Policy. Mobile numbers and text message consent are never shared with or sold to third parties for marketing.
